These Terms of Service (“Terms”) govern your use of mosaicdiy.com and your purchase or use of products and services offered by MosaicDIY.

Nothing in these Terms excludes, restricts, or modifies any consumer right or remedy that cannot legally be excluded under applicable law.

1. About MosaicDIY

MosaicDIY provides products and services including:

• Ready-made DIY mosaic kits
• Custom photo and artwork mosaic kits
• Mosaic pieces and supplies
• Baseplates and modular building components
• Mosaic tools and accessories
• Replacement and refill components
• Large-scale modular mosaic mural projects
• Related educational, creative, and project-planning content

Our core system may translate visual artwork into structured grid, color, module, and build information.

2. Eligibility to Use Our Services

You must be legally capable of entering into a contract in your jurisdiction to place an order directly with MosaicDIY.

If you are not legally able to enter into a binding contract, a parent, guardian, or other legally authorized person must place the order on your behalf.

You agree to provide accurate, current, and complete information when placing an order or contacting us.

3. Product Information

We make reasonable efforts to describe our products accurately.

Product information may include:

• Finished dimensions
• Grid dimensions
• Piece count
• Color count
• Estimated build time
• Difficulty
• Orientation
• Module information
• Pack quantity
• Material
• Compatibility
• Product images
• Other specifications

Some information may vary according to the selected product variant.

Where product information shown for a specific selected variant differs from general informational or educational content elsewhere on the website, the information associated with the selected product or variant at the time of purchase will generally apply.

4. Product Images and Color Representation

We make reasonable efforts to display product colors and visual details accurately.

However, colors may appear differently depending on:

• Screen calibration
• Device type
• Display brightness
• Lighting
• Photography
• Production batch
• Material characteristics

For custom mosaics, the physical mosaic color palette will generally contain fewer colors than the original digital photograph or artwork.

Color optimization is part of converting digital imagery into a buildable physical mosaic.

Reasonable differences between digital artwork and physical mosaic colors do not necessarily mean that the product is defective.

This does not affect your rights where a product is materially different from its description or fails to meet applicable consumer guarantees.

5. Mosaic Size and Build Data

Different size variants may produce different:

• Grid dimensions
• Piece counts
• Color counts
• Module counts
• Finished dimensions
• Build times
• Prices

Build times are estimates only.

Actual completion time may depend on the builder’s experience, working method, project size, breaks, organization, and other factors.

6. Orders

Submitting an order through mosaicdiy.com represents an offer to purchase the selected products.

An automated order confirmation confirms that we have received your order.

It does not necessarily mean that we have finally accepted the order in every circumstance.

We may refuse or cancel an order before fulfillment where reasonably necessary, including in cases involving:

• Payment failure
• Suspected fraud
• Invalid or incomplete order information
• Product unavailability
• Obvious pricing errors
• Technical errors
• Prohibited or unlawful custom content
• Shipping restrictions
• Inability to fulfill the requested customization

If we cancel an order after payment has been collected, we will refund the affected amount where required.

7. Prices

Prices are shown in the currency displayed on the website or checkout.

Prices may change from time to time.

A price change will not normally affect an order that has already been accepted, except where permitted by applicable law in cases such as an obvious pricing or technical error.

8. Obvious Pricing or Technical Errors

If a product is displayed at an obviously incorrect price, we may contact you before fulfillment and give you the option to:

10. Ready-Made Mosaic Kits

Ready-made MosaicDIY kits use an existing MosaicDIY design.

Customers may be able to choose characteristics such as:

• Size
• Format
• Variant
• Other available options

The specifications shown for the selected variant will apply to the order.

Return and cancellation rights for eligible standard products are described in our Refund & Return Policy.

11. Create Your Own Custom Mosaic Kits

Create Your Own products are personalized products created using an image, photograph, artwork, or other content provided by the customer.

Processing may include:

• Image review
• Cropping
• Image preparation
• Grid conversion
• Color optimization
• Size adjustment
• Mosaic layout generation
• Production preparation

The finished mosaic will be an interpretation of the submitted image within the physical limitations of:

• Grid resolution
• Available colors
• Piece size
• Selected dimensions
• Modular construction

It will not be an exact photographic reproduction.

12. Custom Product Approval and Adjustments

Where MosaicDIY provides a preview, proof, crop recommendation, or other design confirmation before production, customers are responsible for reviewing the information provided.

If customer approval is required, production may not begin until approval is received.

Where no approval step is expressly offered, MosaicDIY may use reasonable creative and technical judgment to prepare the image for mosaic production based on the selected product configuration.

Minor adjustments necessary for technical production do not automatically constitute a defect.

13. Customer-Submitted Images and Artwork

By submitting an image, photograph, logo, artwork, graphic, or other content to MosaicDIY, you confirm that:

• You own the content; or
• You have permission or another lawful right to use it for the requested product or project.

You remain the owner of rights you hold in your submitted content.

You grant MosaicDIY a limited, non-exclusive right to use, reproduce, crop, resize, convert, process, transmit, and otherwise handle the submitted content only as reasonably necessary to:

• Review your request
• Create the custom mosaic
• Produce the product
• Fulfill your order
• Provide customer support
• Resolve quality or order issues

This operational permission ends when the relevant processing and reasonable record-retention requirements end, subject to applicable legal obligations.

14. Content We Will Not Produce

MosaicDIY may refuse custom content where reasonably necessary because the content:

• Infringes intellectual property rights
• Violates applicable law
• Is submitted without appropriate authorization
• Contains unlawful material
• Creates material safety or legal risk
• Otherwise cannot lawfully or reasonably be produced or fulfilled

If we refuse an order before production because of submitted content, any refund entitlement will be handled according to the circumstances and applicable law.

15. Customer Content and Marketing

Submitting content for a custom order does not automatically give MosaicDIY permission to:

• Publish it on social media
• Use it in advertising
• Display it in a public portfolio
• Use it in promotional case studies

We will obtain separate permission where required before using identifiable customer content for those purposes.

Our handling of customer-uploaded content is further described in our Privacy Policy.

16. Intellectual Property

Unless otherwise stated, the website and its original content, including:

• MosaicDIY branding
• Logos
• Website design
• Original graphics
• Product photography
• Product copy
• Original mosaic designs
• Grid systems
• Instructions
• Build guides
• Original downloadable materials

are owned by or licensed to MosaicDIY and are protected by applicable intellectual property laws.

Purchasing a MosaicDIY product does not transfer ownership of MosaicDIY intellectual property.

You may use the purchased product and associated instructions for ordinary personal use.

You may not reproduce or commercially distribute MosaicDIY proprietary designs, instructions, digital build files, or other protected content except where we give permission or applicable law permits.

17. Third-Party Intellectual Property

Certain customer-submitted content may contain intellectual property owned by third parties.

MosaicDIY's ability to physically produce a customer-submitted image does not mean that MosaicDIY confirms the customer has legal permission to use that content.

Customers remain responsible for obtaining any permission reasonably required for content they submit.

Nothing in this section removes liability that MosaicDIY cannot lawfully exclude.

18. Mosaic Supplies and Compatibility

Supply products may be intended for particular:

• Piece formats
• Module systems
• Baseplates
• Product generations
• MosaicDIY products

Customers should review compatibility information before purchase.

Where a product is specifically represented by MosaicDIY as compatible with another identified MosaicDIY product or system, that representation forms part of the relevant product information.

19. Large-Scale Mosaic Murals

Large-scale custom mosaic mural projects generally require separate planning and quotation.

A mural project may involve:

• Site dimensions
• Artwork preparation
• Grid resolution
• Module planning
• Component quantities
• Production
• Freight
• Installation
• Project timelines
• Collaborative build planning

Submitting a mural inquiry does not create a binding obligation to purchase or supply a mural.

A binding mural project may be governed by a separate:

• Quotation
• Proposal
• Statement of work
• Project agreement
• Invoice
• Other written agreement

20. Project-Specific Agreements

Where a large-scale mural or other custom commercial project has a separate written agreement, the project-specific terms will take priority over these general Terms where the two directly conflict, to the extent permitted by law.

Mandatory consumer rights cannot be excluded by a project agreement where those rights apply.

21. Shipping

Shipping destinations, costs, processing, tracking, customs, address requirements, and delivery information are governed by our Shipping Policy and the information presented during checkout.

Processing time and carrier transit time are separate.

Delivery dates are estimates unless expressly stated to be guaranteed.

22. Returns, Refunds, and Cancellations

Returns, refunds, replacements, exchanges, and cancellations are governed by our Refund & Return Policy and applicable law.

Eligible non-customized products may be eligible for change-of-mind returns according to our published policy.

Custom and personalized products may be excluded from change-of-mind returns where permitted by applicable law.

Nothing in these Terms restricts rights relating to products that are:

• Defective
• Damaged
• Incorrect
• Not as described
• Otherwise non-compliant with applicable consumer law

23. Promotions and Discount Codes

Promotions may be subject to additional terms.

Unless otherwise stated:

• Promotional codes cannot be exchanged for cash
• A promotion may have an expiration date
• Some products may be excluded
• Multiple promotions may not be combinable
• Promotions may be limited to certain markets or customers

We will not retrospectively change the terms of a promotion after an eligible order has been placed.

24. Gift Cards

Where MosaicDIY offers gift cards, additional gift card terms may apply.

Nothing in those terms will restrict rights that cannot legally be excluded.

25. Reviews, Comments, and Feedback

If you voluntarily submit a product review, comment, suggestion, or non-confidential feedback, you give MosaicDIY permission to use and display that contribution in connection with our business and website.

We will not treat ordinary customer feedback as confidential unless otherwise agreed.

This provision does not automatically authorize MosaicDIY to publicly use customer-uploaded custom photographs that were provided solely for fulfillment of a personalized order.

26. Acceptable Use of the Website

You may not use mosaicdiy.com to:

• Violate applicable law
• Commit fraud
• Interfere with website security
• Introduce malicious software
• Attempt unauthorized access
• Scrape or extract protected content in a manner prohibited by law
• Impersonate another person
• Submit content you have no right to use

We may restrict access where reasonably necessary to protect the website, customers, or our legal rights.

27. Third-Party Services

These Terms apply subject to any mandatory federal, provincial, or territorial consumer rights.

Nothing in these Terms waives any right that cannot lawfully be waived.

33. United States Customers

Consumer protection requirements may vary by state.

These Terms apply subject to mandatory federal and state consumer protection laws.

Nothing in these Terms limits rights that cannot legally be waived.

34. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, these Terms do not exclude or limit liability or legal responsibility for matters that applicable law does not allow us to exclude.

For losses that may legally be limited, MosaicDIY is responsible only to the extent provided by applicable law and the circumstances of the relevant transaction.

We are not responsible for losses caused solely by events outside our reasonable control where applicable law permits such limitation.

35. Use and Assembly of Mosaic Products

Customers should follow product instructions and use reasonable care when assembling or displaying MosaicDIY products.

Products may contain small components.

Keep small components away from young children or others for whom they may present a choking or ingestion hazard.

Product-specific age, safety, installation, or handling information should be followed where provided.

Large wall installations may require appropriate mounting methods based on wall type, product weight, local conditions, and installation environment.

36. Events Outside Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control to the extent permitted by law.

Examples may include:

• Severe weather
• Natural disasters
• Carrier disruptions
• Customs disruption
• War or civil disturbance
• Government action
• Major infrastructure outages
• Widespread supply-chain disruption

Where such an event materially affects an accepted order, we will communicate with the customer and provide remedies required by applicable law.

37. Changes to These Terms

We may update these Terms from time to time.

Changes apply prospectively unless applicable law allows otherwise.

The Terms in effect when an order is accepted will generally govern that order, together with any mandatory legal rights and project-specific agreement.

We will not retrospectively remove consumer rights attached to an existing transaction.

38. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.

39. Governing Law and Consumer Rights

These Terms do not require a consumer to give up the protection of mandatory laws that apply in the country, state, province, territory, or other jurisdiction where the consumer is legally protected.

Any governing-law or jurisdiction rule that may otherwise apply to a transaction is subject to mandatory consumer protection rights.

For commercial or large-scale projects, the applicable governing law or dispute-resolution arrangements may be specified in the separate project agreement.

form the applicable agreement between you and MosaicDIY.

For separately quoted commercial or mural projects, any applicable project-specific agreement also forms part of the agreement and may take priority where expressly stated.
